Nine tips to promote win-win negotiating (no matter the?contract)

On Wednesday, Nov. 7, I?ll have the distinct pleasure of co-facilitating the final MSAE Emerging Professionals brown bag lunch of 2012 with Tammy Dankenbring, sales manager for the Amway Hotel Collection. Discussion will focus on successful negotiation techniques. If your schedule will allow, and you?re not yet registered, please consider attending.

Following is the abridged version of our presentation (and I promise I?ve saved our best examples and talking points for the program ? so I hope to see you there):

1. Contracts differ. Familiarize yourself with the differences among the various contracts your organization routinely executes (e.g., technology, entertainment, speakers, d?cor and hotels). Some contracts may appear to be substantially the same; however, focus on the nuances of the outlier clauses and be sure to understand how they could affect your organization.
2. Trade shoes. Consider the other organization?s perspective during negotiations. You?ll note my intentional use of the word ?organization? here. Negotiating should always promote the best interests of organizations (rather than the self-interests of individuals). Much like your circumstances, the other organization is affected by goals, expectations and limitations.
3. Consider value. A correlation exists between the value of your business and the number of concessions or price breaks your organization can expect to receive during contract negotiations. Evaluate the relative value of your business and negotiate each contract based upon what you can offer the other organization. Focus less on what they can offer you.
4. Avoid ?never.? Refrain from using (or even thinking) blanket statements like ?We never pay for?.? or ?We?ll never agree to an attrition clause.? Quite simply, it breaks down the negotiation process. In fact, it results in something more akin to bullying than it is does negotiating. Instead, carefully consider your organization?s needs and wants, and communicate them accordingly.
5. Develop relationships. The personal and organizational benefits that result when you develop a meaningful relationship with those involved in the negotiating process are invaluable. Don?t underestimate the time it takes to develop these relationships; they do not blossom overnight. Likewise, care should be taken to nurture these relationships, especially between negotiation periods.

In anticipation of this session, I also posted a question to ASAE?s online Collaborate community some time ago seeking various negotiating best practices. Joan Eisenstodt, chief strategist of Eisenstodt Associates LLC and one of the most brilliant minds in the meetings and hospitality industry, was kind enough to reply with the following tips:

1. Ask questions and listen to answers.
2. Go in without a preset agenda ? that is, don?t assume ?no? or ?yes? until you ask and listen.
3. Educate yourself about the person/entity with whom you are negotiating ? know their needs.
4. Look beyond price to conditions.

Readers' Tips for De-stressing Thanksgiving - Mommybites

Dear Readers: Preparing for Thanksgiving and hosting the day can be stressful, yet it can be difficult to give up, modify or change traditions. Many thanks to you, my readers, for sharing some of the things you have stopped doing and/or have started doing to reduce your Thanksgiving holiday stress. Others may benefit from your suggestions. Good food for thought!

No More Trying to Accommodate Dietary Requirements and Preferences
I have stopped trying to accommodate my mother-in-law?s numerous dietary requirements and preferences ? all of which were taking the fun out of my Thanksgiving preparations. For example, garlic and onions make her burp, she doesn?t like chestnuts in her dressing, and she prefers roast pork to turkey. As politely as I could, I asked her to please bring her own dinner this year.

When she seemed a bit insulted about it, I told her that by bringing her own food we could both be assured that everything she ate would be acceptable to her. I reminded her that when it?s just a small gathering I try to plan around her, but for a large Thanksgiving dinner full of traditional dishes, many of which are prepared by others, I am not easily able to do so. My husband totally supports me in this and told his mother so.

I Have Decreed There Will Be No Electronic Devices
This year Thanksgiving in my home is to be digital-free: no i-anythings will be allowed. I am tired of my family working their keyboards and not interacting with each other. My daughter, one of the worst offenders, said, ?You?ve got to be kidding!? I assured her I am serious. I have asked my grandchildren to bring board games and other non-digital activities they can do together. My family may not like it, but they can all send me an e-mail or text after Thanksgiving to complain. My house, my rules.

I?ve Put the Grandchildren to Work
I have four grandchildren under the age of ten coming to my house for Thanksgiving. Last year I set up a table for them on which I had light cardboard cut into place-mat size, crayons, magic markers, and stickers. Instead of running around they worked on making place mats for everyone. They enjoyed being with each other and working on the project together and they asked to do it again this year.

I Will Not Be Bringing My Mother From Assisted Living
My mother lives nearby in assisted living. For the first time I am not bringing her to my home for Thanksgiving. There are about 30 of us and it is noisy and confusing for her, and after about 20 minutes or so, she wants to go home. Getting her here, worrying about her and her wanting to leave after a few minutes is nothing but stressful for me.

This year I will visit with her early on Thanksgiving morning and my sister will visit her later in the day. The staff where she lives assures me that my new plan is better because my mother always returns from a big family gathering agitated and confused. I feel guilty about this, but I realize having her with the whole family is more about my needs than hers.

Assign Everyone a Task
This grandmother (me!) just doesn?t have the energy I used to have (I am 78), so last year instead of my doing everything for Thanksgiving dinner as I have done in the past, I made a list of every task required, e.g., set the table, get the beverage table ready, distribute the hors d?oeuvres, plate the turkey and all the trimmings, clear the dirty dishes, set out the desserts, wrap the leftovers, clean the kitchen, empty the trash, etc. etc.

A couple of weeks before Thanksgiving I let everyone know by e-mail their assignment, including the grandchildren. Everyone knew each other?s assignment, so there was some trading of tasks ? mostly because some family members did not want their task to interfere with the football games on TV.

It worked well and we?re doing it again this year. I think having everyone responsible for some task makes them more aware of what it takes to bring the family together: the Thanksgiving Day feast is a labor of love, but it still is labor!

Changing How Traditional Dishes are Prepared
Our Thanksgiving dinner would not be complete without mashed potatoes. My mother and our Italian aunts (all now deceased) would have a fit over this break with tradition, but it saves so much time and it is actually more nutritious. I now use red potatoes; I cut them into smaller pieces, leave the skins on, and add several garlic cloves to the water. When the potatoes are tender I just use a masher with milk (I heat milk in the microwave so potatoes don?t cool), butter, salt, pepper and chives to taste until I get the consistency I want.

This way skips all of that baloney with an electric mixer, which is just more bowls and stuff to clean. And the little remaining lumps let my guests know that I?ve used real potatoes. Gone are the days of all that ridiculous peeling. When you?re talking 15+ pounds, that?s no small potatoes!

Starting a Totally New Way to Spend Thanksgiving Day
I am completely breaking with our usual Thanksgiving schedule this year. Between my grown and married children rushing around trying to spend part of the day with their in-laws and their relatives, and my trying to work around the grandchildren?s naps, it was becoming a scheduling nightmare for me.

This year my husband and I are going to a restaurant around noon for our dinner and anyone can join us who wants to. Then, I am having an ?open house? through the early evening. Everyone can come and go according to their other commitments. I will provide snacks, fixings for turkey sandwiches and desserts. My family understands why I am doing this and they are willing to give it a try. I already feel so relieved!

School Choice Campaign ? SC issues notice on right to education act

The Supreme Court Monday issued notice to the central government on a petition seeking exemption for unaided educational institutions from earmarking 25 percent seats for students from the weaker sections of the society.

Unaided minority educational institutions are exempted from doing so under the Right to Education Act, 2009, which calls for reserving 25 percent seats for socially and economically backward sections of the society.

An apex court bench of Justice K.S. Radhakrishnan and Justice Dipak Misra issued the notice after senior counsel Mukul Rohtagi contended that Article 15(5) was ultra vires of the basic structure of the constitution as it discriminated between two similarly placed category of educational institutions on the basis of their minority and non-minority status.

Seeking that the matter on the constitutional vires of the Article 15(5) be examined by the atleast five judges constitution bench, Rohtagi said that the constitution envisages equal status for minority and majority.

It would be against the scheme of the constitution to put minority on a higher pedestal then the majority community. Rohtagi was assisted by counsel Govind Goel.

The court was told that the Article 145(3) of the constitution provides that a bench of atleast five judges could only hear a case involving the substantial question of law and the interpretation of the constitutional provisions or for hearing any presidential reference.

The petition moved by 14 non-minority Karnataka based educational trusts and institutions has contended that the provisions of the Right of Children to Free and Compulsory Education Act, 2009 along with Right of Children to Free and Compulsory Education Rules, 2010 are ultra vires of the fundamental rights particularly those guaranteed under Article 14, 15(1), 19(1) and 21 of the constitution.

The present petition is rooted in Apr 12, 2012, apex court verdict that upheld the constitutional validity of the Right to Education (RTE) Act that mandates unaided private schools to keep 25 percent seats for students from economically and socially weaker sections of society.

Then chief justice S.H. Kapadia and Justice Swatanter Kumar by majority judgment had upheld the constitutional validity of Section 12 (1)(C) of the RTE Act, 2009 that provides 25 percent reservation for students from weaker sections of society.

While upholding the constitutional validity of Section 12 (1)(C) of the RTE Act, the majority judgment that was pronounced by chief justice Kapadia (since retired) had exempted the unaided minority educational institutions from earmarking 25 percent seats for students from socially and economically weaker sections of society but same exemption was held back from non-minority unaided institutions.

However, Justice K.S. Radhakrishnan, in a separate judgment, had held that the mandate under RTE Act,2009, providing for reservation of seats was not constitutionally valid, thus none of the unaided schools, be it majority or minority, could be compelled to earmark 25 percent seats in their institutions for weaker sections.

Justice Radhakrishnan read down the Section 12(1)(C) of the RTE Act, 2009, in respect of the unaided non-minority and minority institutions holding that it can be given effect to ?only on the principles of voluntariness, autonomy and consensus and not on compulsion or threat of non-recognition or non-affiliation.?

Florida college band member gets probation in hazing death

ORLANDO, Florida (Reuters) - A former Florida A&M University band member was sentenced on Monday to six months of house arrest and two years of probation in the hazing death of college drum major Robert Champion, who was fatally beaten during a marching band ritual last fall.

Judge Marc Lubet also ordered Brian Jones, 23, to complete 200 hours of community service and a four-hour hazing class. The judge withheld adjudication, meaning Jones will not have a felony conviction on his record.

"I think you're worth saving," Lubet said during the hearing attended by Champion's parents in Orlando.

Lubet said Jones, who faced up to five years in prison after pleading no contest earlier this month to a third-degree felony of hazing causing injury or death, was a "relatively minor participant" in his band mate's beating.

Jones was the first of 12 former members of the historically black college's "Marching 100" band to face sentencing for felony hazing charges filed in Champion's death. The others have pleaded not guilty.

Champion, 26, died in a hazing ritual during a band trip to Orlando on November 19, 2011. His death was ruled a homicide as a result of a hemorrhagic shock caused by blunt force trauma during the hazing on a chartered bus, according to the medical examiner's report.

On Monday, prosecutor Nicole Pegues said two witnesses put Jones at the scene, and one of the witnesses said Jones gave Champion a bear hug.

Champion's mother held a framed picture of her son as she spoke directly to Jones during the hearing.

"How long can you obscure the truth and straddle the fence and keep up the delusion of innocence and live this lie?" Pam Champion asked him.

She told Jones that no matter what sentence the judge handed down, her son's death would "always be there haunting you."

"You and I both know you will never get away," she said. "It will always be with you."

Jones said he hoped the Champion family would find strength in God but didn't mention any specifics about his involvement in the incident.

"It went further than anyone could imagine," he said.

A status hearing for the other 11 defendants is set for March 1, according to prosecution spokeswoman Anna Akers. No trial dates have been scheduled.

The famed band in Tallahassee has been on suspension since Champion's death, and the university president and the band director have resigned.

The Champion family has filed a wrongful death lawsuit against the school. The university is seeking to get the suit dismissed, arguing in court papers that Robert Champion volunteered to be hazed in a bid to gain respect from fellow band members.

Dark Souls, From Software successful RPG released last year on PS3 and XBox360, is getting a new patch for the release of its first DLC pack Artoria of the Abyss on consoles.
Pc gamers have already been enjoying the extra content since the release of Dark Souls : Prepare to die edition on PC.
In a few days (October 23th in the United States and October 24th in Europe) the ?Prepare to die? edition will be hitting consoles: gamers who already bought the game can get the expansion pack from PSN. No mention for the XBox 360 version yet.
The Artorias of The Abyss expansion is a package of new content separate from the main game: it includes new bosses, areas, weapons and armors, non playable characters and new player versus player options.
The DLC will tell the story of Knight Artorias, one of the four knights of Gwyn and the famed ? Abysswalker?.
The new patch will improve the game?s balance and remove a few glitches, like using the Dragon Head for an unlimited amount of times; some spells will be tweaked and some weapons have had their attributes lowered. Some overpowered pieces of equipment like Black Knight Greataxe, Soul Spear, Crystal Soul Spear and Eagle Shield have been nerfed too.
This patch isn?t just bad news for the adventures of Dark Souls? world: the number of bonfires, the game ?s checkpoints, have been increased, making it slightly easier to travel around.

Vice President Joe Biden also talked up his running mate's foreign policy credentials while blasting those of their rival's. Campaigning on Monday in Canton, Ohio, Biden pointed to the tariffs that the administration slapped on Chinese tire imports three years ago, a move that Romney opposed.

"This is the guy who is running ads here non-stop in Ohio saying he is going to get tough on China. C'mon man, C'mon man, please," Biden said.

The last of the three debates is expected to be the most challenging for Romney because of the focus on foreign policy, an area in which Obama has held a strong edge in polling. Ryan sought to prime the audience by saying that the president has embraced the $550 billion in defense spending cuts that are slated be implemented in January 2013 if Congress fails to reach agreement on other spending cuts to offset the increase in the debt ceiling from last summer.

Ryan voted for the bill to raise the debt ceiling that included the cuts, but has offered legislation to defer them, though his measure received no Democratic support when it passed the House in late July.

He also recalled the instance during which Obama was caught on a hot mic telling then-outgoing Russian President Dmitry Medvedev that he would have ?more flexibility? to deal with missile defense after the November elections.

The lobbies have recently approached International Telecommunications Satellite Organization (Intelsat) and Hispasat -- a group of Spanish communication satellites -- and called on them to stop the broadcast of Iranian channels.

In a flagrant violation of the freedom of speech on Monday, European satellite provider Eutelsat SA ordered media services company Arqiva to stop the broadcast of several Iranian satellite channels including Press TV, al-Alam, Jam-e-Jam 1 and 2, Sahar 1 and 2, Islamic Republic of Iran News Network, Quran TV, and the Arabic-language al-Kawthar following an order by the European Commission.

The decision follows months of jamming of Iranian channels by European satellite companies.

This is while the European Union has denied claims by European satellite companies that it ordered the providers to take Iranian channels off the air saying that the companies have acted on their own accord.

BEIRUT (AP) ? Lebanese security forces unleashed a barrage of gunfire and tear gas in central Beirut on Sunday to disperse hundreds of protesters trying to storm the government headquarters after the funeral of a top Lebanese intelligence official killed by a car bomb.

The speedy ignition of the protests demonstrated the flammability of the country's divisive and sectarian politics. The protesters blamed the assassination on the government of neighboring Syria and consider Lebanon's current government to be too close to that embattled regime.

The assassination has laid bare how vulnerable Lebanon is to renewed strife, threatening to shatter a fragile political balance struck after decades of civil strife ? much of it linked to Syria.

Sunday's clashes erupted after the funeral for Brig. Gen. Wissam al-Hassan, who was killed along with his body guard by a Beirut car bomb on Friday. Al-Hassan, 47, was a powerful opponent of Syria in Lebanon.

He was buried in Martyrs Square in downtown Beirut near former Prime Minister Rafik Hariri, another anti-Syrian politician who was assassinated by a truck bomb in 2005.

Syria denied any role in Hariri's killing, but outrage in Lebanon expressed in massive street protests forced Damascus to withdraw its tens of thousands of troops from the country and end nearly 30 years of military and political domination of its smaller neighbor.

The scene at Sunday's funeral was faintly reminiscent of the huge, anti-Syria gatherings in 2005. But the crowd was far smaller than after Hariri's death.

More than 1,000 people walked about a quarter mile from the funeral site toward the stately, hilltop government headquarters. Only a few hundred clashed with the guards, tearing down metal barricades and hitting the guards with the sticks from their flags and placards.

The guards withdrew behind a tall barricade of concertina wire, which the protesters broke through, putting them within 50 meters (yards) of government headquarters. A few guards fired shots and one plainclothes officer pulled a pistol from his belt and fired over the protesters' heads. Then a roar of automatic gunfire erupted, sending the protesters scattering for cover.

It was unclear whether the guards fired in the air or shot blanks, but no protesters appeared to be injured.

In a telephone call with Lebanon's Future TV, former Prime Minister Saad Hariri urged the protesters to stop their attack.

"We are peace supporters and against violence," he said.

The security forces appeared woefully unprepared and their numbers were smaller than those usually deployed for much less contentious rallies.

After about an hour of clashes, more guards arrived, along with scores of helmet-clad commandos. They stood shoulder to shoulder across the road and blocked the protesters from advancing further.

Unrest broke out elsewhere in Lebanon, too. Protesters blocked major roads in Beirut and in the north with rows of burning tires and briefly closed the country's main highway to the south, the national news agency said.

Clashes also broke out in the northern city of Tripoli, with residents of two neighborhoods that support opposite sides in Syria's civil war exchanging gunfire.

Security officials have said six others were killed in the car bomb on Friday, and scores were wounded. But Lebanon's National News Agency said on Sunday that the final toll death toll was three: al-Hassan, his guard and a civilian woman.

The discrepancy could not be explained, though security officials said the other five victims were counted based body parts found at the blast site.

Al-Hassan headed an investigation over the summer that led to the arrest of former Information Minister Michel Samaha, a Lebanese politician who was one of Syria's most loyal allies in Lebanon.

"He was killed while he was defending his country," said Samer al-Hirri, who traveled from northern Lebanon to attend the funeral.

France's Foreign Minister Laurent Fabius said it was likely that Assad's government had a hand in the assassination.

"Everything suggests that it's an extension of the Syrian tragedy," he told Europe-1 radio.

Sunday's protests quickly overshadowed the stately funeral for al-Hassan and his bodyguard.

Before the funeral, giant posters of al-Hassan were set up around Beirut calling him a "martyr of sovereignty and independence."

Thousands of mourners packed central Martyrs Square as soldiers carried in two flag-draped coffins.

"We came for Lebanon's future to show that we will not be scared," said mourner Rama Fakhouri, an interior designer. Many chanted that al-Hassan was a "martyr" who was struck down while trying to protect Lebanon.

TV footage showed al-Hassan's wife Anna, his young sons Majd and Mazen, and his parents, shedding tears near his coffin.

But the mood quickly changed. At one point, a Sunni cleric, Osama Rifai, gave a fiery speech, telling the crowd not to "be like women" and "take out their swords." Lebanese journalist Nadim Qutaish also called on mourners to "storm the government headquarters."

Both men's comments were carried live on TV and crowds of protesters approached the government headquarters soon after.

Al-Hassan's killing has set off a new round of political wrangling in Lebanon.

Before the clashes, Saniora called on Prime Minister Najib Mikati to resign, calling his Cabinet the "government of assassination."

"Staying in your post means that you approve of what happened," he said, adding that al-Hassan's killers "had domestic help."

Many of Lebanon's Sunnis see Mikati's government as too close to Syria and the Assad regime, which is dominated by the Alawites ? an offshoot of Shiite Islam.

A member of Mikati's Cabinet, Ahmad Karami, told the LBC TV station that the prime minister "is not clinging to the post but will not resign under pressure because of the chaos in the country."

Some Lebanese see al-Hassan's killing and Sunday's violence as an extension of Syria's civil war into Lebanon. While Lebanon's Sunnis have largely backed the uprising, many others, especially Shiite Hezbollah, have stood by Assad.

For the protesters, the connection was clear.

"The Syrian regime started a war against us and we will fight this battle until the end," said protester Anthony Labaki, a 24-year-old physiotherapist.

For years after Syria's 2005 pullout from Lebanon, there was a string of attacks on anti-Syrian figures in the country with impunity. Assad managed to maintain his influence in Lebanon in the years afterward through Hezbollah and other allies.

Samaha, the former minister arrested in al-Hassan's investigation, remains in custody. He is accused of plotting a wave of attacks in Lebanon at Syria's behest.

Syrian Brig. Gen. Ali Mamlouk, one of Assad's most senior aides, was indicted in absentia in the August sweep that saw Samaha arrested. Samaha's arrest was an embarrassing blow to Syria, which has long acted with impunity in Lebanon.
