David Kersh: Time-travel to Peru With My Son

My eight year old son, right before going to sleep, says he wants to go on a trip to Lima, Peru -- the place I was born in and grew up before coming to Los Angeles -- so he can see me as a little kid.

What can I say? There is something so charming about the thought that travel, from his perspective, could be not just about going from point A to point B on a map, but from being a forty-something year old man to a child his same age. So, as he is all bundled up inside the blanket, and his eyes struggle to remain open, I hold his hand and wonder what such a trip would look like.

There are some complications, of course. For starters, I would have to figure out at what stage to transform myself from my current physical state of a somewhat responsible parental figure to the little kid I once was, the one my son wishes to get in contact with. I would venture to say it should happen sometime after we got through security at LAX; if not, that would most likely guarantee us a false start, and the two of us kids would be put in a taxi by a TSA representative and sent back home to my wife. The bathroom in the airplane? There, I would walk out with oversized pants dragging along the aisle and empty ends of the shirt sleeves dangling alongside my reduced body. Can I sit here? Hey, it's your papi, for real. In that transformed state, it would be hard to scold him for playing his video games too long, or deny him the coke he is asking the air hostess, who is trying to figure out what is going on here. Needless to say, it might be better to leave this transformation business, for now, as a literary device. If not, we will never get to Lima.

Not to be a party-pooper, but interspersed with the sweet moments of recovering and sharing lost time with my son, there are serious matters to consider. Take the fake police alarm on top of my cousin's black Toyota when he comes to pick us up at the airport. I imagine he would be the one to pick us up, as that was the way the last time I was in Lima, about twenty years ago, after I finished college. Things were pretty awful back then. There was terrorism, cholera, bombs, black-outs, bodyguards, kidnapping -- you know, the usual stuff. My cousin had this fake alarm to help him get to places quicker, along with the gun in the glove compartment next to the bag of peanuts. Things seem better these days in Lima, but my cousin's nostalgia for those days keeps him from giving up his fake alarm. At some point along the way my son would take notice that even the police cars are pulling over to let us pass by. Knowing him, he would relish this state of lawlessness, which would mean, among other things, that the tireless efforts on the part of my wife and I in the realm of rule-making would be literally and figuratively thrown out the window.

Looking out the window -- the literal and figurative one -- and as traces of the past mix with poverty and decrepit streets, I am torn between letting him sleep or pointing out significant sentimental places, for, after all, that is why we are here. There are the obvious choices, such as my dad's bakery with the friendly bakers in the back, which one morning, when I was his age, was bombed to pieces as an act of Anti-Americanism. Undoubtedly, he would be more interested in the present tense and its realizable goals -- actually eating the tasty chocolate pastries -- than in dusty memories of wooden tables sprinkled with flour or the crema chantilly I licked off my fingers once upon a time. You got to hand it to the kid, his practical nature, unlike his melancholic dad with a soft spot for lost worlds.

Oh, and how could we not place a visit to my grandparent's house, the geographical heart of my childhood! My grandfather, though a dictator to everyone else in the family, was for me the greatest person in the world. At that house, he would stop playing his game of solitaire over in the corner table and, cigar-smoke billowing around his massive figure, have me ask him in Yiddish -- bitte mia gelt -- "please give me some money," before peeling off a fresh ten soles bill. Surely, my son would pick up on this ritual, and seek to put it into practice on a daily basis -- which would mean I would have to include this as part of the travel expenses. Of course, we would have to go to my Jewish grammar school, which shows up in every story I write about Peru. Once there, we would poke our heads through the heavily guarded spinach-green gate, and have him figure out which one of the boys in the gunpowder gray uniform singing the Israeli national anthem is his papi. Most likely, given his rebellious nature, he would get it wrong on purpose, and point to my friend Jacobo, who, in all fairness, looked a lot like me. Though, rather than being traumatized for leaving Lima as a little boy, never left the city and was recently jailed for tax evasion, mortgage fraud and counterfeiting. Oh well, not the greatest of career choices.

Now, there is a good chance that while hanging out together in the Lima of my childhood, my eight-year old son and the eight-year-old version of me could stumble upon the smells and sights of another Lima, meaning the one from my post-college trip. He has not yet asked to meet that part of me, so I guess that itinerary -- with its twenty-something existentialist homelessness drama -- will just have to wait for another night.

How the major stock indexes fared on Thursday (AP)

A brief morning rally pushed the Dow Jones industrial average above its highest closing price since the financial crisis Thursday, but stocks closed lower after mixed economic data tempered traders' optimism.

Solid news on factory orders and strong earnings from U.S. manufacturers highlighted one of the economy's bright spots before the market opened. The Dow and broader indexes turned negative after weaker reports on home sales and future economic growth were released in the late morning.

The Dow closed down 22.33 points, or 0.2 percent, at 12,734.63.

The Standard & Poor's 500 index closed down 7.63 points, or 0.6 percent, at 1,318.43.

The Nasdaq shed 13.03 points, or 0.5 percent, to close at 2,805.28.

For the week so far:

The Dow is up 14.15 points, or 0.1 percent.

The S&P 500 is up 3.05 points, or 0.2 percent.

The Nasdaq is up 18.58 points, or 0.7 percent.

For the month and year so far:

The Dow is up 517.07 points, or 4.2 percent.

The S&P 500 is up 60.83 points, or 4.8 percent.

The Nasdaq is up 200.13 points, or 7.7 percent.

Analysts mull impact of accident on cruise sector

NEW YORK (AP) ? Shares of cruise operators declined on Tuesday, with analysts questioning whether the capsizing of a Carnival Corp. vessel would hurt travel demand just at the start of the important bookings season.

The Friday night capsizing of the Costa Concordia off a Tuscan island has left at least 11 people dead, according to the latest reports on Tuesday.

Greg Badishkanian of Citi Investment Research said in a client note that the accident could be an overhang on shares of Carnival and rival Royal Caribbean Cruises Ltd., as it took place during the cruise industry's busiest booking period of January through March, commonly known as wave season.

Badishkanian said that cruise booking volumes likely fell 6 percent to 10 percent over the past few days but stressed that the decline is within normal day-to-day volatility.

Pricing is still firm and there has been no material increase in cancellations, he added, "which means there is no major passenger fear of cruising thus far."

But Badishkanian says that negative press surrounding the capsizing is not helping, as pictures and videos are more graphic and widespread than previous cruise incidents.

"The media coverage could also be prolonged as the 100-year anniversary of the Titanic is in three months," he added.

In two separate reports, Susquehanna Financial Group's Rachael Rothman lowered the ratings of Carnival and Royal Caribbean, both based in Miami, to "Neutral" from "Positive." She also reduced Carnival's price target to $29 from $40 and cut Royal Caribbean's price target to $26 from $39.

The analyst said that the bad press will probably "be a severe headwind to bookings in the months ahead," adding that wave season can make up close to about 35 percent of annual bookings.

Carnival's stock slid $4.73, or 13.8 percent, to $29.55 in afternoon trading. The stock is trading at the low end of its 52-week range of $28.52 to $48.13. Shares of Royal Caribbean fell $1.03, or 3.6 percent, to $27.72.

Explosions used in hunt for 29 missing on Italian liner (Reuters)

GIGLIO, Italy (Reuters) ? Rescue squads used controlled explosions on Tuesday to enter a stricken Italian cruise liner in the increasingly despairing hunt for survivors as authorities almost doubled their estimate of the number missing on the huge vessel to 29 people.

The Costa Concordia's owners accused their captain of causing Friday's disaster by veering the ship too close to shore, where it hit a rock, in a bravura "salute" to residents of a Tuscan island off Italy's Mediterranean coast.

Captain Francesco Schettino was arrested on Saturday accused of manslaughter and abandoning the ship before all people were evacuated, and he was due to appear before magistrates for questioning on Tuesday morning.

Prosecutors say Schettino also refused to go back on board when requested by the coastguard.

The three explosions were carried out early on Tuesday morning to allow firefighters and scuba divers to enter and leave parts of the ship that they had not yet been able to search.

"Now we will have better access to the gathering points on the ship, where it seems there might be more chance of finding someone, dead or alive," said firefighters' spokesman Luca Cari."

"They will take micro-cameras in there, and we will be simultaneously looking at the few remaining dry areas and also the wet areas," he said.

The weather improved slightly from Monday but seas were still choppy.

The giant cruise liner slid a little on Monday, threatening to plunge 2,300 tonnes of fuel below the Mediterranean waters of the surrounding nature reserve.

The slippage forced rescuers to suspend efforts to find anyone still alive after three days in the capsized hull, resting on a jagged slope outside the picturesque harbor on the island of Giglio. Six bodies have been found. Most of the 4,200 passengers and crew survived, despite hours of chaos.

An Italian coastguard official told Reuters late on Monday that the number of people missing had been revised up to 29 - 25 passengers and four members of staff - from 16, showing how much uncertainty still surrounded the disaster.

Another maritime official said later that 10 Germans were thought to be among the missing passengers.

The 114,500-tonne ship, one of the biggest passenger vessels ever to be wrecked, foundered after striking a rock just as dinner was being served on Friday night. It quickly rolled on its side, revealing a long gouge below the waterline.

Cari said there were still small movements of the vessel but they were not considered dangerous. Searches were suspended overnight before resuming on Tuesday morning.

Another senior firefighter, Luciano Roncalli, told Reuters that all the unsubmerged areas of the liner had been searched, indicating there was faint hope of finding more survivors in the flooded and upturned maze of luxurious state rooms and tennis courts, bars and spas now submerged beneath the sea.

Environment Minister Corrado Clini said he would declare a state of emergency because of the risk that the ship's fuel would leak into the pristine Tuscan Archipelago National Park. No fuel spillage has been detected so far, he said on Italian television on Monday evening.

Clini said on Tuesday morning he had given the salvage company until Wednesday to come up with a plan to remove the fuel and 10 days with a plan to remove the ship.

Should rougher seas dislodge the wreck and cause it to sink or break up, that could scupper any hopes for the owners, a unit of Florida's Carnival Corp., of salvaging a liner which cost hundreds of millions of dollars to build just six years ago.

Investigators say the ship was much too close to the shore and its owners, Costa Cruises, said the captain had carried out the rash maneuver to "make a bow" to people on Giglio island, who included a retired Italian admiral.

Schettino denies charges of manslaughter.

"You don't have to be a Nobel prize winner to understand that a ship of that size should stay far from the coast," Clini, the environment minister, said on television on Tuesday morning.

His lawyer issued a statement saying the skipper was "broken up, troubled and saddened by the loss of life." But he believed he had saved many lives by carrying out a difficult emergency maneuver with anchors after the accident, which turned the ship closer to the shore.

The father of the ship's head waiter told Reuters that his son had telephoned him before the accident to say the crew would salute him by blowing the ship's whistle as they passed close by Giglio, where both the waiter, Antonello Tievoli, and his 82-year-old father Giuseppe live.

Costa Cruises chief executive Pier Luigi Foschi on Monday blamed errors by Schettino for the disaster. He told a news conference the company would provide its captain with any assistance he required. "But we need to acknowledge the facts and we cannot deny human error," he added.

Foschi said company vessels were forbidden to come closer than 500 meters (1,650 feet) to the Giglio coast. Investigators say the liner, designed as a floating pleasure palace for over 3,000 customers, was about 150 meters (yards) offshore when it hit the rocks that tore a long gouge in its thousand-foot hull.

Schettino denies being too close to the coast and says the rock he hit was not marked on charts.

The calm weather which since Friday has aided the search of the wreck, by some estimates the biggest passenger vessel ever to founder, took a turn for the worse on Monday with rougher seas and a light drizzle falling. Forecasters said it would get worse.

The ship is resting in about 20 meters (60 feet) of water but could go down by as much as 130 meters if it shifts free from the rocks.

Carnival Corp, the ship's Miami-based parent company, said it estimated the impact on its 2012 earnings for loss of use alone to be around $90 million. Its share price closed down around 16 percent on the London market.

The Sleep Apnea Business Is Booming, And Insurers Aren't Happy

Snoring was once considered a simple annoyance for bed partners, but there is a growing awareness in the medical community that the grunts and snorts of noisy sleepers can also be a sign of sleep apnea.

It's a condition shown to increase the risk of several serious illnesses, including heart disease, stroke and dementia. Critics, however, worry that overnight tests to diagnose apnea, particularly those done in sleep labs, may be over-prescribed, at great cost to the health care system.

Testing can be a lucrative business, and labs have popped up in free-standing clinics and hospitals across the country. Over the past decade, the number of accredited sleep labs that test for the disorder has quadrupled, according to the American Academy of Sleep Medicine.

At the same time, insurer spending on the procedure has skyrocketed. Medicare payments for sleep testing increased from $62 million in 2001 to $235 million in 2009, according to the Office of the Inspector General.

Sleep apnea occurs when the muscles in the back of the throat relax. That causes an airway obstruction that can stop a person's breathing for several seconds ? even minutes. It causes restless sleep and, sometimes, dangerously-low blood oxygen levels. The disorder can be diagnosed by monitoring a snorer's sleep patterns, either in an overnight visit to a sleep lab or at home using a portable testing device. It's then often treated with a CPAP machine that helps keep a snorer's airway open during sleep.

Sleep apnea has likely become more common because the population has grown older and more obese ? two major risk factors for the disorder. The National Institutes of Health estimates that more than 12 million Americans suffer from the apnea. Many are never diagnosed.

"The medical community is sort of dropping the ball," Dr. David Gross, medical director of the sleep lab at the National Rehabilitation Hospital in Washington, D.C., says. "It's just sad when you walk through the hospital and you see these patients with heart failure ? the person might be 35 years old, he's 350 pounds ? but no one's thinking that he has sleep apnea, which he statistically does." Gross says more than three-quarters of the patients who come to his lab are diagnosed with apnea.

But the testing isn't cheap: Each night at a hospital sleep lab can cost $1,900 and is usually mostly covered by a patient's health insurance. Some patients end up spending two nights at the lab ? one to test for apnea and the second to try the CPAP machine.

Dr. Fred Holt, an expert on fraud and abuse and the medical director of Blue Cross Blue Shield in North Carolina, says some patients aren't having basic exams done first and are therefore being prescribed expensive tests they don't need. Not everyone who snores has a chronic disorder, he says. In other cases, Holt says, the labs prescribe CPAP machines right away without first suggesting other strategies that could reduce apnea, such as losing weight or sleeping on your side.

"We are spending more and more money on sleep testing and treatment," he says, "and like anything else in health care, there are unscrupulous people out there who are more than happy to do testing and treatment that might be of questionable value. This might be because of naivet? on the part of the physician, or unfortunately, it could be done for the sake of improving the cash flow of the business."

It's no secret that the sleep business can be lucrative for physicians. A website for Aviisha, a sleep testing company, has a special page for physicians showing a picture of a doctor with a stack of money in his lab coat pocket. And in February, the American Academy of Sleep Medicine is offering a seminar on the "business of sleep medicine for physicians" at a golf resort in Arizona.

While many sleep centers offer comprehensive care for sleep disorders, others are largely focused on overnight sleep testing, according to Dr. Nancy Collop, president of the academy. "A lot of people have gotten into the sleep business specifically to do that procedure," she says. The goal of the academy's accreditation process, she says, is to make sure sleep labs are offering more, because "many patients may not even need a sleep study."

Helen Darling, president of the National Business Group on Health, which represents large employers offering health insurance to their workers, says the tests are driving up the cost of premiums. "This is a good example of something where we have technology, we have financial incentives to use more of it then we've historically done. You have enough problems, including a growing obesity epidemic, and you sort of put together the so-called perfect storm for driving up overuse and health care costs."

Doctors should focus instead on common-sense approaches to sleep apnea, she says, like losing weight, before turning to expensive testing and medical devices.

Another option is a home sleep test, which costs less than a fifth as much as a lab test, and is considered effective for most patients. Medicare began paying for home sleep tests in 2008, but the tests have had only modest growth.

"I believe lab tests, as opposed to the home tests, are being wildly overprescribed," says Michael Backus, senior vice president of American Imaging Management, a subsidiary of WellPoint.

Right now, 99 percent of the sleep tests given to WellPoint patients are done in the lab, he says, but "it should be 70 percent at home and 30 percent in the lab." Backus adds that the majority of patients who are diagnosed with apnea and then given CPAP machines stop using them within the first year.

Some insurers, including WellPoint, are changing the way they pay for sleep testing to curb the costs. Many now require a special pre-authorization. They also ask the doctor whether a patient qualifies for a home sleep test instead of one at the lab. Those changes are now widespread among Massachusetts insurers and are having an effect on the sleep industry in the state.

Dr. Lawrence Epstein, the chief medical officer of Sleep HealthCenters in Massachusetts, says the labs have already experienced a 20 percent drop in the number of patients coming in for testing. While the past decade was focused on industry growth, he says it's "now going to be about consolidation and provision of better quality, more efficient care."

Sleep HealthCenters has shut down three of its 15 sleep labs, and more closures may be on the way. Epstein says the company is focusing more on "sleep wellness," including treating and managing sleep disorders, and less on testing. The key, he says, is to become more efficient without decreasing access to care for patients who need it.

Police: 2 people wounded in shooting at Mo. mall (AP)

KANSAS CITY, Mo. ? A young man and woman were wounded Saturday in a shooting that locked down a suburban Kansas City mall and sent panicked shoppers running for cover.

Independence police spokesman Tom Gentry said two young men have been identified as persons of interest in the afternoon shooting at Independence Center. He said the two men had an altercation with the victims while going through a doorway and the shooting happened when the two pairs met up later.

Gentry said the victims were taken to a hospital with wounds that weren't considered life-threatening.

"Everything is fine, everything is secure" at the mall, Gentry told The Associated Press. "No one else is in a position to be harmed."

The mall, located about 10 miles east of Kansas City near Interstate 70, was locked down after the shooting and closed early. Mall officials did not immediately return a phone call to the AP for comment.

Police were interviewing a dozen or more witnesses. Gentry didn't know whether they were talking to the two persons of interest.

He said he didn't know where the shooting happened in the mall. But television station KMBC reported that the shooting happened just outside of the Sears store.

Police Capt. John Cato told the station that two people entering the store got into an argument. "That verbal altercation progressed into a physical altercation and eventually shots were fired," he said.

People left strollers behind in the parking lot because they were in such a rush to leave the mall, KSHB-TV reported.

"We just heard, `Pop, pop, pop,' and I literally just started screaming to my boss, `Run! There was gunshots.' And we just, we grabbed our stuff, shut the alarm on and just took off running," Andrew Boyce told KMBC. "I mean there were probably a couple of hundred people running toward the southeast exit."

(San Francisco, CA, January 12, 2012)?The following is a joint statement from Lambda Legal, the National Center for Lesbian Rights, the American Civil Liberties Union, Gay & Lesbian Advocates & Defenders, and Freedom to Marry:

We write to respond to a news report from Canada that a lawyer in the current government has taken a position in a trial-level divorce proceeding that a same-sex couple?s marriage is not valid because the members of the couple were not Canada residents at the time that they married, and the law of their home jurisdiction did not permit them to marry at the time.

No one?s marriage has been invalidated or is likely to be invalidated. The position taken by one government lawyer in a divorce is not itself precedential.? No court has accepted this view and there is no reason to believe that either Canada?s courts or its Parliament would agree with this position, which no one has asserted before during the eight years that same-sex couples have had the freedom to marry in Canada.

Canada permits non-residents to marry and thousands of non-resident same-sex couples have married there since Canada first began recognizing the freedom to marry for same-sex couples in 2003. Indeed, Canada?s Parliament codified the equal right to marry for same-sex couples in 2005.

The message for same-sex couples married in Canada remains the same as it is for same-sex couples validly married here in the United States: take every precaution you can to protect your relationship with legal documents such as powers of attorney and adoptions, as you may travel to jurisdictions that don?t respect your legal relationship. There is no reason to suggest that Canadian marriages of same-sex couples are in jeopardy, or to advocate that people try to marry again elsewhere, as that could cause these couples unnecessary complications, anxiety, and expense.

Video: U.S. Marine video 'insane', says Afghan president



>>> good evening. if you have a combat veteran in your household or your family, perhaps they can tell what you happens over there. what happens to young men who volunteer for duty at 18 years of age and find themselves in withering daily combat, fighting an insurgency in an unforgiving place. sometimes over multiple combat tours. while that's some of the context of what the u.s. marine corps is dealing with right now, it doesn't begin to address or explain the pictures that the u.s. secretary of defense today called utterly deplorable. it's a web video showing american marines urinating on the bodies of the enemy and providing commentary along the way. it is a terrible and potentially disastrous image for the u.s. around the world. we begin tonight for this widening problem for the pentagon. our correspondent there jim miklazewski on duty tonight. jim , good evening.

>> reporter: brian, the marine corps has one word for this video, disgusting. the four marines in the video have been identified. two are in custody at camp lejeune in north carolina . the two others were previously assigned to other units. tonight, one of them may even be back in afghanistan . the video first posted on the internet sent shock waves around the world. it shows four u.s. marines in full combat gear urinating on the bodies of three dead militants. at one point the marines can be heard joking about their antics. they were part of a sniper team deployed to afghanistan . two are being questioned by naval investigators. within hours after the video surfaced, game in avalanche of condemnations. the state department today, secretary of state hillary clinton called the video deplorable.

US deplores video of Marines urinating on dead (AP)

WASHINGTON ? Defense Secretary Leon Panetta has promised Afghanistan President Hamid Karzai a full investigation of an Internet video that purports to depict four U.S. Marines urinating on the corpses of Taliban fighters ? a video both men condemned Thursday as deplorable.

At least two of the four men have been identified as Marines based at Camp Lejeune, N.C., said a Marine official, speaking on condition of anonymity because there is an active criminal investigation of the incident.

In a public statement, Panetta said such behavior is "entirely inappropriate for members of the United States military" and that those responsible will be held accountable.

The video, posted on the Internet, shows men in Marine combat gear standing in a semi-circle over three bodies. It's not clear whether the dead were Taliban or civilians or someone else. The title on the posting called them Taliban insurgents and said the men were from Camp Lejeune.

Officials did not officially verify the video's origin or authenticity but had no evidence to doubt what it was.

"It clearly appears to be to us what it appears to be to you ? troops urinating on corpses," Pentagon spokesman Capt. John Kirby told reporters Thursday.

The two men who have been identified were members of 3rd Battalion, 2nd Marines, based at Camp Lejeune, the main Marine base on the East Coast., said the official speaking anonymously. Some of the four are no longer in that battalion, which returned from Afghanistan last fall, said the official, who gave no other information about them.

The video was roundly denounced in the U.S. and Afghanistan alike.

Karzai called it "completely inhumane." The Afghan Defense Ministry called it "shocking." And the Taliban issued a statement accusing U.S. forces of committing numerous "indignities" against the Afghan people.

"First they killed the Afghans with mortars, and they then urinated on their bodies," Taliban spokesman Zabiullah Mujahid said of what is shown in the video. "We strongly condemn this inhumane action by the wild American soldiers."

Secretary of State Hillary Rodham Clinton expressed "total dismay" at the video and said it was "absolutely inconsistent with the standards of behavior that the vast majority of Marines hold themselves to."

Panetta, who phoned Karzai to discuss the incident, said the actions in the video, if confirmed, were inexcusable.

"I have seen the footage, and I find the behavior depicted in it utterly deplorable. I condemn it in the strongest possible terms," Panetta's statement said. "Those found to have engaged in such conduct will be held accountable to the fullest extent."

The video came to light at a delicate time in relations among the United States, Afghanistan's elected government and the Taliban insurgency fighting for both territorial control and cultural and religious preeminence in Afghanistan. The U.S. is trying to foster peace talks between the Karzai government and the Pakistan-based Taliban high command, and has made unprecedented offers to build trust with the insurgents, including the planned opening of a Taliban political office to oversee talks.

One of the largest obstacles to peace discussions has been widespread Afghan contempt for U.S. military tactics. Opposition to the U.S. and NATO military presence in Afghanistan usually centers on civilian casualties from military engagement, although the vast majority of those deaths are caused by the insurgents. The video is likely to resonate with those opposed to the U.S. presence and to peace with the U.S.-backed Karzai government.

U.S. officials seemed to have ordered a variety of investigations:

_Panetta said he had ordered the Marine Corps and Marine Gen. John Allen, the top commander of the NATO-led forces in Afghanistan, to fully investigate.

_In a written statement, the commandant of the Marine Corps, Gen. James Amos, said he requested on Wednesday evening that the Naval Criminal Investigative Service investigate, and that the Marines would, separately, do their own internal investigation.

"The Marine Corps will not rest until the allegations and the events surrounding them have been resolved. We remain fully committed to upholding the Geneva Convention, the Laws of War, and our own core values," Amos said.

The NATO-led security force in Afghanistan released a statement Thursday saying, "This disrespectful act is inexplicable and not in keeping with the high moral standards we expect of coalition forces."

The actions "appear to have been conducted by a small group of U.S. individuals, who apparently are no longer serving in Afghanistan," the International Security Assistance Force said. The statement did not identify the personnel or explain why the ISAF thought they had left the country.

A spokesman at Camp Lejeune in North Carolina would not confirm reports that the Marines were based there. "We have had elements of that unit that have deployed to Afghanistan and have returned. However, we have not yet confirmed if anyone in the video is from that unit, or whether they are attached to a unit from Lejeune," said Capt. Scott Sasser.

Pentagon officials said the criminal investigation would likely look into whether the Marines violated laws of war, which include prohibitions against photographing bodies and detainees and a range of other rules.

Mujahid urged the U.N. and other international groups to end such actions by U.S. troops.

On Wednesday, the Council on Islamic-American Relations, a prominent Muslim civil rights and advocacy group based in Washington, protested the video in a letter to Panetta.

"We condemn this apparent desecration of the dead as a violation of our nation's military regulations and of international laws of war prohibiting such disgusting and immoral actions," the group wrote.

"If verified as authentic, the video shows behavior that is totally unbecoming of American military personnel and that could ultimately endanger other soldiers and civilians," the letter said.

"El Gordo," Largest Distant Galaxy Cluster Ever Seen, Spied by Astronomers in Chile


AUSTIN, Texas - The largest cluster of galaxies seen yet in the early universe, a giant that astronomers have dubbed "El Gordo," could one day reveal secrets about the invisible dark matter that fills the universe, researchers said.


El Gordo, which means "the fat one" in Spanish - is officially known as ACT-CL J0102-4915 and "is located more than 7 billion light-years from Earth, at a time when the universe was half its current age," study co-author John Patrick Hughes at Rutgers University told SPACE.com. The universe is about 13.7 billion years old.


The monster galaxy cluster has mass about 2 quadrillion (that's 2 followed by 15 zeroes) times that of the sun, making it "the most massive known cluster in the distant universe."


A galaxy cluster behemoth


Galaxy clusters form through mergers of smaller groups of galaxies. These events depend on the amount of dark matter and dark energy in the universe, and thus could shed light on these enigmas. [See the El Gordo galaxy cluster]


Dark energy seems to make up 73 percent of all the mass and energy in the universe, and is driving the accelerating expansion of the universe. Unseen and as-yet-unidentified dark matter makes up about 23 percent of all the matter and energy in the universe ? scientists know it exists because of the gravitational effects it has on galaxies. The regular matter that makes up humans, planets and stars constitutes only 4 percent of the universe.


El Gordo was discovered using NASA's Chandra X-ray Observatory in space and the Atacama Cosmology Telescope in Chile. Its Spanish nickname is a nod to the Chilean connection.


The scientists detailed their findings today (Jan. 10) at the annual meeting of the American Astronomical Society here during a presentation that included a separate announcement of the discovery of the most distant galaxy cluster ever seen in the early universe.


El Gordo, a hot galaxy group


Gas in El Gordo can reach super-high temperatures of nearly 360 million degrees Fahrenheit (200 million degrees Celsius), based on X-rays collected by Chandra and the European Southern Observatory's Very Large Telescope in Chile.


"This cluster is the most massive, the hottest, and gives off the most X-rays of any known cluster at this distance or beyond," said study lead author Felipe Menanteau of Rutgers University.


This heat, as well as the fact that galaxies within the cluster are concentrated in two distinct groups, suggests El Gordo is the site of a violent merger between two galaxy clusters.


"Galaxies are moving within the cluster at speeds of typically 3 million miles per hour," Hughes said.


Although a cluster of El Gordo's size and distance is extremely rare, it does fit within the standard Big Bang model of cosmology. This suggests the universe is composed predominantly of dark matter and dark energy, and began with a Big Bang about 13.7 billion years ago.


"Gigantic galaxy clusters like this are just what we were aiming to find," Hughes said. "We want to see if we understand how these extreme objects form using the best models of cosmology that are currently available."


Future research can seek to model how dark matter separates from the gas in El Gordo, Hughes said. This could yield key details about dark matter's nature.


A paper describing these results has been accepted for publication in the Astrophysical Journal.

'Forrest Gump' actor Sinise to raise money for vet (AP)

TEMECULA, Calif. ? Actor Gary Sinise, known for playing a soldier who loses his legs in the film "Forrest Gump," wants to stage a benefit concert to raise money to build a home in Temecula, Calif., for a Marine who lost his limbs in Afghanistan.

The Los Angeles Times reports ( http://lat.ms/Aw0bi1) that Sinise, now starring in TV's "CSI New York," is expected to ask the Temecula City Council on Tuesday if he can hold a concert tentatively on March 1.

Sinise's Lt. Dan Band, named for his movie character, would perform and raise money for Marine Lance Cpl. Juan Dominguez, who lost his legs and right arm in 2010.

The Gary Sinise Foundation and the Stephen Siller Tunnel to Towers Foundation have built several such homes for wounded veterans.

UT-Arlington's new arena is the centerpiece of College Park district

ARLINGTON - It's called College Park Center.?

It's the centerpiece of the new College Park district that's transforming UT-Arlington, perhaps more than any other development in the school's history.

"Even though it's only a 6,600 seat facility, it has the feel of a much larger professional venue," said David Skaggs with HKS architects.

HKS also did the new Cowboys Stadium, the American Airlines Center and TCU's recent stadium renovation.

"This is going to be right up there with the AA Center in terms of quality and kinds of technologies it has, and the fan experience," Skaggs said.

Giant video screens for fans, and luxurious, state-of-the-art training facilities, lounges and learning centers for student athletes.

It's all designed to draw high-caliber basketball players, and thus draw more attention to UTA itself, and its 34,000 students.

"I think if you look at large, research schools across the state or the country, they all have top-notch athletic programs," said UTA Vice President John Hall.

The $78-million arena will also host concerts, big name lectures and graduation ceremonies. It's the kind of building UTA and the City of Arlington have never had.

The entire College Park district includes on-campus housing for another 600 students, a new welcome center and a new park. Much of it was paid for by prominent Arlington business people.

"The total cost for the College Park district is $160 million," Hall said. "A little more than $30 million has come from external sources."

Thus, it will be the Petsche Basketball Court, Dan Diepert Welcome Center, Moritz Plaza and Vandergriff Hall.

For a school without the storied past of a TCU or SMU, UTA is out to make some history, and make some noise in its new arena starting in February.

Take Control Of Your iOS Messages With Messages+ For iPhone

As much as I love iOS and the devices that it runs on, as a user I have always felt there has been certain aspects of the operating system and the native application experience which are fundamentally broken. In previous articles I have discussed my love of the Photos applications that comes preinstalled on iOS, and the problems that it comes with. Well now it is the turn of the native Messages application to get the same treatment.

As you are probably aware, when you take your shiny new iDevice out of its box and power it up, it comes with a preinstalled version of iOS. That version is generally the most recent iteration of the software at the time of shipping. iOS has a default set of applications which are bundled onto the device with the most notable being Messages, Photos, YouTube, Settings and the App Store application. As mentioned above, it is the Messages application that I wish to focus on, as this has been a problematic app for me over the years as I believe it lacks certain features.

The Messaging application on an iPhone is pretty self explanatory, and is elegant in its simplicity. Upon opening it, you are presented with a UITableView containing any text conversations you may have going on, along with an edit and a compose option, which is as complicated as it gets. When selecting a conversation, a new view is presented featuring all of the incoming and outgoing messages as part of that particular conversation. You will notice that the navigation bar buttons change to reflect the new view, now presenting the user with an edit button on the right hand side and an option which takes you back to the messages list on the left. My problem doesn?t relate to the presentation of data, but more to the options given to the user on how to deal with, compose and reply to text messages.

As a stock iOS user you basically have one option if you want to compose or reply to a message ? stop what you are doing and enter into the messages application. In earlier versions of iOS the experience was nothing short of terrible due to the big alert view which took of your display if an incoming text was received. It provided a terrible user experience, solely because it meant you had to leave what you were doing to reply, or even if you wanted to dismiss the alert, by that time your experience had already been compromised. iOS 5 made some small baby steps to improve the messaging application by introducing a new notification system which produces unobtrusive banners along the top of the display, which could either be acted upon or simply left to dismiss themselves. Whilst this does prove to be an elegant way of handling incoming messages, it still didn?t add any real functionality to the messages app to make it the powerhouse it deserves to be. Considering an estimated 7 TRILLION messages are sent per day across the world, surely a texting application should be all it can be.

iOS software development company Intelliborn seem to agree with my opinion, and have put a large amount of work into developing the Messages+ application which lives within the Cydia store for jailbroken devices. The developers at Intelliborn are certainly not backwards in going forwards and have proclaimed Messages+ as the "Best SMS Compose and Reply App". For those in the know around the jailbreaking scene, Message+ is a rebranded, and updated version of the app known as Tlert which has been available through Cydia for some time. After being heavily updated and modified to feature total iOS 5 support, Messages+ is ready for the prime time with iMessage compatibility. The application aims to drastically enhance and improve the native messaging experience and benefits from the following features:

  • Compose an SMS to anyone, from within any app.
  • Reply to any incoming message, from within any app.
  • Send and view video or picture messages within conversation mode.
  • Respond to an incoming text or iMessage without closing the currently open application.
  • Hooks into the native messages application to enhance it, rather than replace it.

As you can see from the list of features, Messages+ greatly improves the rather soggy messaging experience on an iDevice by using what they call ViewThrough patent pending technology which provides users with information relating to new events and information. So what does all this messaging goodness cost? As is usually the way with premium Cydia purchases, Messages+ has a price tag of $7.99 but also comes with a free trial period to allow new users to try before they buy. The good news is, that if you are an existing license holder of Tlert, Messages+ is treated as an upgrade and will be available to you free of charge.

Is the Consumer Electronics Show Doomed?

The Consumer Electronics Show is a very big event. Sure, attendance seems to drop off a bit in response to recessions, but for the past 10 years, CES has drawn between 100,000 and 157,000 people to Las Vegas, and PM will be there next week for CES 2012. (Here's our list of what to expect from this year's show.)

The show started on the other side of the country in the summer of 1967, with around 100 or so exhibitors and 17,500 attendees crowding into the Hilton and Americana hotels in New York, and the focus was on home audio equipment and televisions. CES has introduced multiple legendary products, including the VCR (1970), CD player (1981), DVD player (1996), HDTV (1998), and plasma TV (2001). Early on, the show was a twice-a-year event, but it eventually settled into a single show in Las Vegas in January to showcase the upcoming year?s products. Also, the focus has shifted significantly toward digital gadgets, both as a consequence of the rise of digital home electronics and of the implosion of the COMDEX computer show in the early 2000s. For most of the last decade, then, CES has been a must-attend event for most of the tech world, with companies such as Sony, Microsoft, Intel, and Samsung making splashy introductions of each year?s new product lines.

Yet, as CES has gained momentum, there have also been some powerful forces building that will ultimately be its undoing. Indeed, these trends point to trouble for trade shows in general. The current leader in the tech world noticed this early on: Apple has never participated in CES in a meaningful way, initially preferring to headline Macworld, a trade show dedicated to all things Apple, then abandoning even that show in 2009. Now the company hosts all of its own events. Many companies now follow that model?planning their own events to create buzz for significant product launches. Yet many of these companies continue to come to CES out of pure inertia?they come because they feel they must.

Not anymore. Last December, Microsoft corporate VP for communications Frank Shaw wrote on the company blog that, after this year, Microsoft would no longer have keynotes or booths at CES. Why? Because the idea of a yearly product cycle is an anachronism. Modern technology moves much faster than that now, and so does the media that covers it. (Although it?s worth noting that some companies have historically had the opposite problem?they unveil a complex product in development as a half-baked prototype at CES well before it?s ready.) The news of a cool new gadget can now saturate the Internet before the press event promoting it has even ended. Sometimes, the news breaks before the event even begins. I personally learned about the $199 price of Amazon?s Kindle Fire from a Twitter post while sitting in the audience waiting for CEO Jeff Bezos to take the stage at the announcement event.

What?s more, the very volume of new products at CES makes it a terrible place to stage an introduction in the first place. Sure, your cool widget is bound to get covered by somebody, but plenty of significant innovations get drowned out by the chaos of the show. If the purpose of a splashy announcement is to get people?s attention, it?s best to have their full attention.

In fact, this has become a general problem with trade shows?everybody shows up because they feel they have to, but the most innovative companies aren?t saving up their big product announcements for somebody else?s party anyway. Car shows are still a notable exception, since there are multiple shows throughout the year, such as next week?s big North American International Auto Show in Detroit, that allow for a rolling series of new car unveilings. But power tool makers, fancy food purveyors, and other manufacturers of the stuff we love and want to know more about are aware that there are far easier ways to get the word out.

Does this mean that the Consumer Electronics Show is dead? Yes, at least in its current form as a behemoth media event. But there are good reasons for it (or something like it) to linger on in a vastly diminished show. Companies such as Microsoft, Apple, Intel, Google, and Facebook have unique and interesting products that allow those brands to easily manufacture their own buzz. But there are other big electronics companies such as Sony, Samsung, LG, Pioneer, Panasonic, and Sharp that produce huge product lines of commodity products like TVs, laptops, and stereos, that benefit from a wide stage that a trade show provides. Where else can you spread out 30 TVs and parade people by them? (There is, of course, a larger business question about the wisdom of producing large and confusing product lines, but that?s for another article.)

If innovative companies leave and take their big announcements with them, then far fewer people are going to show up, and the public at large will probably not pay as much attention. But these shows were not originally intended to be big, public brouhahas. The original CES had 17,500 attendees (a fraction of the current crowd), almost all of whom were in the electronics trade?because, after all, it was a trade show.

Roku expands beyond Internet video-streaming boxes (AP)

SAN FRANCISCO ? Roku is thinking outside its set-top box in an attempt to bring more Internet video to flat-panel televisions.

The new approach will rely on a finger-sized device that won't require extra cords or separate remote controls to stream video over high-speed Internet connections. The product, called the Roku Streaming Stick, will plug directly into a high-definition port available on a growing number of new-breed TVs, just as a flash drive fits into a computer's USB outlet.

The streaming stick won't be available until the second half of this year, but Roku announced it Wednesday to get a jump on the onslaught of consumer gadgets that will be unveiled next week at an annual electronics show in Las Vegas.

Roku's streaming stick will only work on televisions that have mobile high-definition links. The technology, known as MDL, is being backed by a group that includes Samsung Electronics Co., Sony Corp. and Toshiba Corp.

Although it's still a small company, Roku Inc. has emerged as a significant player in the steadily growing market for Internet video since it introduced its first set-top box nearly four years ago. Originally designed to deliver Netflix's Internet streaming service to big-screen TVs, Roku's boxes now include more than 400 different online entertainment options.

As Roku added more choices, the prices of its boxes have fallen to as low as $50 ? down from device's original price of $100. The price cuts and expanded programming line-up helped Roku sell about 1.5 million streaming boxes last year, tripling its volume from 2010. The privately held company says it had about $150 million in revenue last year. It won't say whether it's profitable.

The streaming stick is expected to sell for $50 to $100. Electronics retailer Best Buy Co. plans to include the streaming stick in a line of TVs bearing its in-store brand, Insignia.

Roku, which is based in Saratoga, Calif., decided to develop a more condensed version of its set-top box to cater to so-called "smart" TVs. That's become a catchphrase for TVs that can be used to show content from stored on websites and mobile devices in addition to the more conventional fare from cable and satellite carriers.

Unlike smartphones running on software made by Apple Inc., Google Inc. and other technology vendors, smart TVs still remain more of a geeky novelty than a household staple.

Google has tried to widen the acceptance by developing Internet-surfing software for smart TVs, but that effort hasn't made much headway since it launched 15 months ago. Apple is believed to be working on a smart TV that could hit the market this year or next year. .

US state dept acknowledges 'goof up' in its India maps

As US State Department on Wednesday posted a new map of India [ Images ] reflecting its long standing official position on the country's geographical boundaries, its spokesman acknowledged of having made a "goof up" in this regard, which had resulted in a strong objection from New Delhi [ Images ].

"We made a goof and we fixed it and we're now back in compliance with our own cartographical policy," State Department spokesperson Victoria Nuland told reporters at her daily news conference as she announced the posting of the new and corrected maps of India on the website of the State Department and its travel related sites.

The previous controversial maps, which showed parts of Jammu and Kashmir [ Images ] as part of Pakistan, was removed by the State Department in November after India's strong objection.

India maintains that the entire state of Jammu and Kashmir is an integral part of the country.

"I'm thrilled and relieved to tell you that we have now put the revised maps up on our website," she said.

"What you will see when you look at these maps is that they reflect the fact that the United States takes no position on the dispute and urges all the parties to seek a peaceful resolution to resolving the claims," she said.

"What you'll see on the maps is consistent with what the US geographic position has been consistently: that there is a dashed line representing the 1972 Line of Control [ Images ], reflecting Kashmir's unresolved status," Nuland said.

"We neglected to actually label that dotted line in the last round of maps. It has now been labeled. The maps also add our standard disclaimer with regard to Kashmir that says that names and boundary representations are not necessarily authoritative. As I said, that reflects the fact that this is in? dispute and the US takes no position on the dispute," she said.
